Terms of Use

This document is available in French (reference version) and in English. In the event of any discrepancy in interpretation between the two versions, the French version shall prevail.
1. Purpose
These Terms of Use (hereinafter the "Terms of Use") govern access to and use of the Gatesly website (hereinafter the "website"). By accessing the website, you unreservedly accept these Terms of Use.
2. Contractual documents
Use of the service is governed by two complementary documents:
- These Terms of Use, which govern access to the website and use of the service.
- The Terms and Conditions of Sale, which govern commercial transactions (purchase of a plan per event, invoicing, liability, force majeure).
In the event of a conflict between the Terms of Use and the Terms and Conditions of Sale, the Terms and Conditions of Sale prevail for all commercial and financial matters.
3. Nature of the service
Gatesly is an event management and check-in platform that allows organizers to create events, manage participant lists, generate individual QR codes and perform real-time check-ins.
The service is offered at two access levels:
- Free access: browsing the website.
- Paid access: use of the event management features (creating events, importing participants, generating QR codes, check-in / attendance tracking, statistics and exports) is subject to prior payment of access per event, according to the rates in force on the website.
4. Website access and pricing terms
Browsing the website is free of charge (excluding internet connection costs). Creating an account is free. However, access to the following features is subject to payment of access per event:
- Creating and publishing an event
- Managing and importing the participant list
- Generating personalized QR codes
- Scanning and checking in participants
- Access to attendance statistics and exports
The applicable prices are those displayed on the website at the time of ordering. Any activated access is due in full, even in the event of partial use. Gatesly reserves the right to modify its prices at any time; changes take effect for any new purchase after the update.
Gatesly also reserves the right to modify, suspend or interrupt all or part of the service at any time, without notice, without this giving rise to a refund except where required by mandatory legal provisions.
5. Payment and invoicing
Payment for access to an event is due before any activation of the associated paid features. The detailed payment and invoicing terms are set out in the Terms and Conditions of Sale.
An activation confirmation is sent by email to the address associated with the account once payment has been validated. In the event of a payment issue, access to paid features will be suspended until the situation is regularized.
6. User accounts
Creating an account provides access to advanced features such as creating events, managing participants and viewing statistics. You undertake to:
- provide accurate and up-to-date information when registering;
- keep your login credentials confidential;
- report any unauthorized use of your account;
- not share your account with third parties.
Gatesly reserves the right to suspend or delete any account in the event of a breach of these Terms of Use.
7. Event and participant data
Within the meaning of the GDPR (EU 2016/679), you act as data controller for the personal data of participants that you register on the platform. Gatesly acts as a processor and only processes this data according to your instructions and for the sole purpose of providing the service.
In that capacity, you undertake to:
- only register data that is necessary for managing your events (data minimization);
- have informed your participants of the use of their data and, where applicable, have obtained their consent, in accordance with articles 13 and 14 of the GDPR;
- not use participant data for purposes other than managing your events;
- delete the data of participants who request it within the timeframes provided by the regulations.
Gatesly does not sell or share participant data with third parties for commercial purposes. To learn more about how we process this data, please consult our Privacy Policy.
8. Prohibited conduct
It is notably prohibited to:
- attempt to access non-public areas of the website or compromise its security;
- extract, scrape or massively reuse content without prior authorization;
- publish unlawful, defamatory, hateful content or content that infringes the rights of third parties;
- use the website in a manner contrary to applicable laws and regulations.
9. Intellectual property
The website and its content (texts, logos, graphic elements, etc.) are protected by copyright and intellectual property rights. Any unauthorized reproduction, representation or reuse is prohibited.
10. Liability
Gatesly makes every effort to ensure access to and the proper functioning of the website but does not guarantee the absence of errors, interruptions or unavailability. The website is provided "as is".
In the event of a failure attributable to Gatesly, the publisher's liability is limited to direct damages only and may not exceed the amount paid by the user for the event concerned.
Gatesly shall not be held liable for indirect damages such as loss of revenue, loss of customers, damage to reputation or loss of data resulting from the use of or inability to use the service.
Cases of force majeure suspend Gatesly's obligations and cannot engage its liability. They are defined in the Terms and Conditions of Sale.
11. Personal data and cookies
The processing of your personal data is described in our Privacy Policy. Information relating to cookies and trackers is also set out in that policy.
12. Suspension and termination
In the event of a breach of these Terms of Use or abusive use of the website, Gatesly may restrict, suspend or delete access to the user account, without prejudice to any legal action.
13. Changes to these Terms of Use
We may modify these Terms of Use for legal, technical or operational reasons. The last update date will be adjusted accordingly. In the event of major changes, we may inform you by an appropriate means.
14. Governing law and jurisdiction
These Terms of Use are governed by French law. Any dispute relating to their interpretation or performance shall be submitted to the competent courts of the jurisdiction where the company is registered, subject to any mandatory legal provisions to the contrary.
